    Tuesday 2/17/15 –   The New Water Cooler:  How Email, Social Media, Facebook and Other Types of Communication through Technology Could Legally Impact Your Workplace

    Objective:

    Employees communicate with each other and the outside world through email, social media, Facebook, texts and tweets.  Employers sometimes enact policies prohibiting employees from gossiping, making disparaging comments about their co-workers, managers or the company, or disclosing “confidential” company information such as wages and personnel actions.  The National Labor Relations Board has been increasingly challenging these policies (yes, even in non-union environments) as having a chilling effect on employees who wish to exercise their rights under Section 7 of the National Labor Relations Act.  In addition, the discovery process in legal proceedings now includes “e-discovery,” which means that every electronic communication between or concerning the parties to the lawsuit is at issue and could potentially be discovered.  In this session, we will discuss policies, practices and problems that could lead to potential liability.  We will also review practical tips for protecting employer interests.
